1. General Provisions
These Terms and Conditions apply to all voyages operated by In The Same Boat AS. By purchasing a ticket or chartering a vessel, passengers agree to comply with these terms and all applicable laws and regulations for the areas of the operation/cruise.
2. Compliance with Laws and Regulations
Passengers must comply with all instructions from the crew, including safety procedures, and requirements from maritime regulations. Our operations adhere to Norwegian maritime law, the International Regulations (SOLAS, COLREG, IMO and more), and environmental protection laws.
3. Passenger Responsibilities and Conduct
- Passengers must behave in a manner that ensures their own safety, the safety of other passengers, and the well-being of everyone onboard.
- Any reckless or dangerous behavior, including failure to follow crew instructions, may result in removal from the vessel at the closest available port.
- Passengers are responsible for any damage they cause to the vessel, its equipment, or any property onboard due to non-compliance with rules and instructions. The cost of repair or replacement will be charged to the passenger.
4. Safety and Security
- The Captain and crew have full authority over the vessel and its passengers.
- If a passenger poses a threat to safety, security, or the well-being of others, In The Same Boat AS reserves the right to disembark the passenger at the closest available port without any refund or compensation.
- Passengers must follow all safety briefings and participate in emergency drills as instructed by the crew.
- The safety responsibility of the captain an the maritime crew ends when the passengers leave the vessel, also for shorter visits in a bigger itinerary, except when the activities on land is being organized by In The Same Boat.
5. Liability and Disclaimer
- In The Same Boat AS is not responsible for personal belongings lost, stolen, or damaged during the voyage.
- In The Same Boat is not liable for any personal injury, accident, or illness unless caused by gross negligence, where In The Same Boat’s insurance also will apply.
- Passengers travel at their own risk and should ensure they have appropriate travel insurance covering medical emergencies, trip cancellations, and personal liability.
6. Amendments and Cancellations
- The company reserves the right to cancel or modify itineraries due to weather conditions, safety concerns, or operational reasons.
- In the event of cancellation by In The Same Boat AS, passengers may be offered an alternative voyage or a refund as per our refund policy.
7. Specific rules on board
- No smoking on board (inside and outside on deck)
- Heavy intoxication (by alcohol) is prohibited
- All forms of drugs are prohibited
- Everyone myst follow the vessel’s hygiene regulations
- The vessel has limited resources, be aware of your water- and energy consumption
- Passengers have a responsibility for not bringing bedbugs or similar insects to the boat
8. Acceptance of Terms
By purchasing a ticket or chartering a vessel, when boarding the vessel, passengers acknowledge that they have read, understood, and agreed to these terms and conditions.
