For å være sikker på at begge parters forventninger til hverandre blir oppfylt så godt som mulig, har vi laget noen enkle vilkår for hva det innebærer å være bidragsyter til In The Same Boat.

Et bidrag er en såkalt «donasjon uten motytelse». Det vil si at man bidrar med penger gjennom en donasjon, uten at man får levert et produkt eller tjeneste i retur. Når man bidrar med en donasjon aksepterer man disse vilkårene. En donasjon er ikke å anse som en avtaleinngåelse, ettersom det ikke leveres et produkt eller tjeneste, men vi forplikter oss likevel til å oppfylle formålet med donasjonen, dvs. å rydde så mye plast som mulig fra havet.

Partene

Mottaker av det økonomiske bidraget er In The Same Boat, Havnegata 11, 8800 Sandnessjøen, post@inthesameboat.no, orgnr. 919620978, og betegnes i det følgende som mottakeren. Bidragsyteren er den privatpersonen, næringsaktøren eller organisasjonen som gir bidraget.

Størelse på bidrag

Den oppgitte og selvvalgte størrelsen på bidraget er den totale summen giver skal betale. Denne summen inkluderer alle avgifter og tilleggskostnader. Ytterligere kostnader som bidragsmottaker måtte ha for å kunne motta bidraget, som bidragsmottaker ikke har informert om, skal ikke bæres av giveren.

Levering

En donasjon skjer uten motytelse, det vil si at det leveres ingen produkt eller tjeneste som følger av en donasjon. Givere under 18 år kan ikke betale med etterfølgende faktura.

Angrerett og oppsigelse av løpende bidrag

Ved donasjoner gjelder ingen angrerett men løpende bidrag kan stanses når som helst, da det ikke er noen binding.

Oppsigelse av løpende bidrag må skje senest 5 virkedager før avtalt dato for trekk, og kan skje gjennom å sende epost til bidrag@inthesameboat.no eller ved å fylle ut skjema på http://www.inthesameboat.eco/stansbidrag

Personopplysninger

Behandlingsansvarlig for innsamlede personopplysninger er mottaker. Med mindre giver samtykker til noe annet, kan mottaker, i tråd med personopplysningsloven, kun innhente og lagre de personopplysninger som er nødvendig for at selgeren skal kunne gjennomføre forpliktelsene etter avtalen. Giverens personopplysninger vil kun bli utlevert til andre hvis det er nødvendig for at giver skal få gjennomført avtalen med kjøperen, eller i lovbestemte tilfelle.

Tredjeparts håndtering av data

Vi jobber med tredjeparts samarbeidspartnere innen pengeinnsamling og salg, og disse vil håndtere et minimum av nødvendig personinformasjon å vegne av oss.

Konfliktløsning

Klager rettes til mottaker innen rimelig tid, jf. punkt 9 og 10. Partene skal forsøke å løse eventuelle tvister i minnelighet. Dersom dette ikke lykkes, kan giveren ta kontakt med Forbrukerrådet for mekling. Forbrukerrådet er tilgjengelig på telefon 23 400 500 eller www.forbrukerradet.no.

Europa-Kommisjonens klageportal kan også brukes hvis du ønsker å inngi en klage. Det er særlig relevant, hvis du er forbruker bosatt i et annet EU-land. Klagen inngis her: http://ec.europa.eu/odr.

Terms and conditions – GDPR (English)

To ensure that both parties’ expectations are met as closely as possible, we have created some simple terms for what it means to be a contributor to In The Same Boat, or member in our CARE Program.

A contribution is a so-called “donation without consideration.” This means one contributes money through a donation without receiving a product or service in return. By giving a donation, one accepts these terms. A donation is not considered a contractual agreement, as no product or service is delivered, but we nevertheless commit to fulfilling the purpose of the donation, i.e., to remove as much plastic from the ocean as possible.

Parties

The recipient of the financial contribution is In The Same Boat, Havnegata 11, 8800 Sandnessjøen, post@inthesameboat.no, org. no. 919620978, and is referred to hereinafter as the recipient. The contributor is the individual, business entity, or organization providing the contribution.

Amount of Contribution

The stated and self-selected amount of the contribution is the total amount the donor shall pay. This amount includes all fees and additional costs. Additional costs that the recipient may have to incur in order to receive the contribution, which the recipient has not informed about, shall not be borne by the donor.

Delivery

A donation occurs without consideration, meaning that no product or service is delivered as a result of a donation. Donors under 18 years of age cannot pay by subsequent invoice.

Right of Withdrawal and Termination of Ongoing Contributions

No right of withdrawal applies to donations, but ongoing contributions can be stopped at any time, as there is no binding contract.

Termination of ongoing contributions must be made no later than 5 working days before the agreed withdrawal date and can be done by sending an email to bidrag@inthesameboat.no or by filling out the form at http://www.inthesameboat.eco/stansbidrag.

Personal Data

The data controller for collected personal data is the recipient. Unless the donor consents otherwise, the recipient, in accordance with the Personal Data Act, may only collect and store the personal data necessary for the seller to fulfill its obligations under the agreement. The donor’s personal data will only be disclosed to others if necessary for the donor to complete the agreement with the buyer, or in cases required by law.

Conflict resolution

Complaints should be addressed to the recipient within a reasonable time, cf. points 9 and 10. The parties shall attempt to resolve any disputes amicably. If this is not successful, the donor can contact the Consumer Council for mediation. The Consumer Council is available by phone at +47 23 400 500 or www.forbrukerradet.no.

The European Commission’s online dispute resolution platform can also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. The complaint can be submitted here: http://ec.europa.eu/odr.
